Judge Orders Council to Hand Dog Back to Owner

A Nottinghamshire judge has ruled that a dog should be returned to its owner, more than a year after it was seized. Jason Singh from Greenacre, Edwalton, had his pet dog Zeke confiscated in June 2007 as Rushcliffe Borough Council deemed that it was prohibited under the 1991 Dangerous Dogs Act – a view not shared by Judge Morris Cooper.

Judge Cooper said that ‘Zeke is clearly a delightful, friendly dog and shows no sign of aggression at all’, prior to ordering the dog should be reunited with his owner. Zeke is not, in fact, a banned pit bull terrier, but is a cross with a Dogue de Bordeaux, a type of French mastiff . Mr Singh proclaimed his delight at the decision, saying ‘It has been over a year – and it’s been absolute hell but it’s been worth it and I’ve had a lot of people supporting me.’

Rushcliffe Borough Council later released a statement outlining their disappointment with the decision, claiming it had not suggested the dog was dangerous, but instead that it was a banned breed under the Dangerous Dogs Act.
