Dog Owner Refuses to Pay Compensation After Attack

Fri, 04 Jun 2010

A dog owner has refused to pay compensation to a woman who required hospital treatment after being attacked by the lady’s pet dog. Magistrates at Sheffield Magistrates Court decided against making a dog destruction order having head how Emma England was bitten on her right leg by the three year old Jack Russell, but did order Samantha Egglestone to pay a £100 fine, £150 in court costs and a victim surcharge of £15. Egglestone agreed to pay these charges, but – despite risking a prison sentence – refused to pay the £150 compensation to Miss England, claiming the neighbours who Miss England were visiting had treated her animal badly. The magistrates also imposed a court order requiring the dog to be kept under control in public.

Egglestone did apologise to Miss England at the time of the attack, and told her that the pet was attending therapy and a dog behavioural class already. The pet dog, Charlie, has already been reported to the police on three occasions for aggressive behaviour, but had not previously attacked a person.

The issue of dangerous dogs has attracted significant media attention in recent years, prompting vets and the RSPCA to work with the government in an attempt to crack down on the issue.
