Following the death of Ruby Wax's sister in law, Network Rail is being prosecuted for two offences under the Health and Safety at Work Act.
Julia Canning, aged 55, was killed when she was using a crossing at Fairfield near Marlborough, Wiltshire, by a high speed train upon her dog pulling her onto the line.
The Office of Rail Regulation, who is enacting the prosecution, emphasised the two alleged offences.
The first charge alleges that between 12 June 1999 and 8 May 2009 Network Rail did not conduct its undertaking in the way that provided a safe method for individuals using the bridleway and footpath crossing.
The second offence alleges that between the same dates Network Rail failed to carry out its undertaking whereby people were not exposed to health and safety risks.
Network Rail did not make appropriate arrangements to control the preventative and protective measures at the bridleway and crossing.
A spokesperson stated that: "The first hearing was before Salisbury Magistrates earlier this month when no plea was taken."
The case also highlights the importance of taking extra care when walking dogs. From this case it would appear that it would be most appropriate to keep away from train tracks.
